Assessment 1 Digital Images part 2

  Image Regulations

    1. Copyright is the legal right to create copies of material. This means if someone creates something and obtains a copyright for it then no one is allowed to use it without their permission. Copyright is to stop people from using things without people approval.
    2. We have copyright laws in order to protect the creators and owners of work. If there were no laws then any work done by someone could be claimed by anyone.
    3. In Australia copyright law last the life of the creator of the work and then plus another 70 years after they die.
    4. If you break copyright laws the person can come get an order from the court and come into your property and seize the material you copyrighted. They could also file a claim for damages(Hanrahan et al., 2021).
      a) One example is when a photographer named Art Rogers shot a photo of two people holding a bunch of puppies in a line. An artist named Jeff Koons saw this image and decided to make a statue of the picture and sell them. Art Rogers took Koons to court and the court decided to images were too similar and Koons had to pay Rogers.

      b) Marvin Gayes estate was payed by Robin Thicke due to the song Blurred Lines sounding too much like Gayes Got to Give it Up. Gayes estate was payed 7.5 million dollars which is the most expensive copyright infringement payout ever in the music industry.
    5. In order to use copyrighted material you need to be able to change it enough that the material has a whole new expression or meaning.
    6. Moral rights are the rights of creators or copyrighted law.
    7. Moral rights are asserted by letting people know that you are wishing to assert the right in the first place.
